Service Description
Colorado Pest Control provides residential, commercial, and industrial pest management services throughout the State of Colorado. Our services include, but are not limited to, inspection, identification, treatment, prevention, and ongoing monitoring of common pest organisms including insects, rodents, birds, and wildlife. Treatment methods may involve chemical applications, baiting systems, trapping, exclusion techniques, organic solutions, and integrated pest management programs tailored to specific property conditions and client needs. Service frequency may vary from one-time treatments to recurring monthly, bi-monthly, or quarterly maintenance programs.
All services are performed by licensed applicators in accordance with Colorado Department of Agriculture regulations and applicable federal guidelines including the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). Service details, including scope, pricing, and scheduling, are specified in individual service agreements or work orders executed prior to treatment. Colorado Pest Control reserves the right to modify treatment protocols based on site conditions, weather, pest pressure, regulatory changes, or safety considerations without prior notice. We do not provide structural repairs, renovation services, or guaranteed permanent pest elimination, as pest activity is influenced by numerous environmental factors beyond our reasonable control.
No Guarantee or Warranty
Colorado Pest Control makes no express or implied warranties regarding the complete or permanent elimination of pests from any treated property. Pest biology, environmental conditions, neighboring property influences, and client activities all affect treatment outcomes. Any service warranties or retreatment guarantees are limited to the specific terms, duration, and conditions explicitly stated in a signed written service agreement. These limited warranties do not extend to new pest infestations, pest species not covered in the original service scope, or recurrences resulting from client actions, structural deficiencies, or circumstances outside our control.
We do not guarantee against property damage, health issues, or economic losses related to pest presence or treatment activities. All pesticide applications carry inherent limitations and risks disclosed on product labels and safety data sheets. Clients acknowledge that complete pest elimination is biologically unfeasible in most environments and that our services aim to manage pest populations to acceptable thresholds rather than achieve absolute eradication.
User Responsibilities
Clients must provide accurate property information, disclose known pest conditions, and inform Colorado Pest Control of any health sensitivities, allergies, or special circumstances affecting household members, pets, or property operations prior to service. Clients are responsible for preparing treatment areas as instructed, including but not limited to removing food items, covering fish tanks, securing pets, and providing adequate access to treatment zones.
Clients must not interfere with applied treatments, tamper with installed bait stations or monitoring devices, or apply additional pesticides without consultation, as this may reduce efficacy or create safety hazards. Payment obligations must be satisfied according to agreed terms. Failure to comply with preparation instructions, access requirements, or post-treatment recommendations may void any limited warranties and result in additional service fees.
Limitation of Liability
To the maximum extent permitted by Colorado law, Colorado Pest Control's total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific service giving rise to the claim. We shall not be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, property damage, personal injury, or emotional distress, regardless of whether such damages were foreseeable or whether we were advised of the possibility thereof.
This limitation applies regardless of the legal theory asserted, whether contract, tort, negligence, strict liability, or otherwise. Clients assume all risks associated with pesticide applications, including risks to vegetation, beneficial organisms, and non-target species, notwithstanding our exercise of reasonable care. Our liability for damages to real or personal property is limited to direct repair or replacement costs and excludes any claim for diminution in property value or aesthetic harm.
Intellectual Property
All content, materials, trademarks, service marks, logos, trade names, photographs, videos, written content, treatment protocols, and proprietary methodologies displayed on Colorado Pest Control websites, marketing materials, and service documentation are the exclusive property of Colorado Pest Control or its licensors. Clients and website users receive no license or right to use, reproduce, distribute, modify, create derivative works from, or display any such intellectual property without our prior written consent. Unauthorized use may violate federal and state trademark, copyright, and unfair competition laws.
Client testimonials, photographs, or feedback provided to Colorado Pest Control may be used in marketing materials with appropriate attribution, unless the client explicitly requests confidentiality in writing. Technical information disclosed during service provision remains our confidential proprietary information.
Governing Law
These Terms of Service and any disputes arising from or relating to Colorado Pest Control's services shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of laws principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Denver County, Colorado. Clients consent to the personal jurisdiction and venue of such courts and waive any objection to such jurisdiction or venue.
Colorado Pest Control complies with all applicable Colorado statutes, including the Colorado Consumer Protection Act and regulations promulgated by the Colorado Department of Agriculture Pesticide Applicators Act. Nothing in these terms shall be construed to waive any rights or remedies available to consumers under Colorado law that cannot be lawfully disclaimed.
Changes to Terms
Colorado Pest Control reserves the right to amend, modify, or update these Terms of Service at any time without prior individual notice. Revised terms become effective upon posting to our website with an updated effective date. Continued use of our services following such changes constitutes acceptance of the modified terms. Material changes affecting existing service agreements will be communicated to active clients via email or written notice at least thirty days before implementation. Clients are encouraged to review these terms periodically. The terms in effect at the time of service performance govern that specific service.

All formal legal notices must be sent by certified mail to our principal Colorado business address on file with the Colorado Secretary of State. Telephone inquiries do not constitute legal notice for purposes of dispute resolution or warranty claims.
